Babiva Hair Extensions

Babiva Affiliate Program terms is a legal agreement between Babiva and you ("affiliate"). By signing up to be an affiliate in Babiva Affiliate Program ("program") you agree to be bound by the following terms and conditions. Please ensure that you read carefully before signing up.

1. The Agreement

1.1. An Affiliate must provide full legal name, valid address, e-mail address and any other information requested in order to create an Affiliate account.

1.2. An Affiliate must have a valid PayPal address to receive commission payments and include this on their profile during registration.

1.2. ‘we’ Babiva reserves the right to update and change these ‘Terms’ from time to time without notice.

1.3. Any modifications or changes to the Program shall be subject to these terms.

1.4. You may not use the Program for any illegal or unauthorised purpose.

Violation of these terms may result in suspension of your rights to be an Affiliate and result in lost commissions and/or removal from the Program.

2. Modification of Babiva affiliate program terms

‘We’ Babiva reserves the right to modify or change the terms of the agreement at any time. In the case of any modifications of the terms and conditions in this agreement, it is up to the affiliate to stay updated on the terms of this agreement as we (Babiva) may change terms without notice from time to time. If the affiliate doesn't accept any modification, the affiliates option is to end the agreement.

3. Affiliate account

In order to enter the Babiva Affilate Program, the affiliate needs to create a log-in and password. From this account the affiliate is able to track and view sales, and receive commission payments.

4. Methods of Advertising

4.1. Affiliates are permitted to use links, discount codes, any related banners, or text advertisements provided by Babiva Affiliate program.

4.2. Affiliates are not permitted to promote any non-affiliate program related materials, such as coupon codes provided in customer newsletters, codes provided to other affiliates, any promotional codes, or codes received from any source other than directly from the Babiva affiliate program.

4.3. The promotion should include the offer, discount code, link provided by Babiva affiliate program and expiration date.

4.4. Affiliates must remove invalid codes and banners.

4.5. Affiliate coupon codes and links are not to be promoted on third party websites such as coupon databases.

4.6. Affiliates are permitted to promote their coupon code and link on their personal social media platforms only and must not share this information on any Babiva social pages. 

4.7. Any sales that have been generated through improper promotion, will result in loss of commission.

4.8. Affiliates may not advertise any other brand of hair extensions whilst enrolled in the Babiva affiliate program. Should the affiliate wish to advertise another brand of hair extensions, the affiliate is responsible for ending the partnership with BABIVA by sending an e-mail. Should BABIVA find that the affiliate is promoting another brand of hair extensions during the Affiliate term with BABIVA without receiving prior notification by e-mail, this may result in suspension of your rights to be an Affiliate and result in lost commissions and/or removal from the Program.

4.9. ‘We’ Babiva reserves the right to take legal action against Affiliate that commits fraud.

4.10. Affiliate codes will be changed on a frequent basis and affiliates will be contacted with their new code. All old codes must be removed and replaced with the new discount code. 

5. Copyrighted material

Affiliate is responsible for ensuring that product descriptions and images comply with all applicable copyright, trademark, data protection, any intellectual property right or any other applicable law. BABIVA will not be responsible if an affiliate uses another party's copyrighted material in violation of law.

6. Payments

6.1. Affiliates receive a commission for sending authorized sales via links provided by Babiva Affiliate Program. The customer must make a purchase by clicking the link on affiliate's website within 30 days of the initial click-through.

6.2. The commission is based on product that is sold. Payments are made once an affiliate reaches minimum of $50 of commissions required for a payout

6.3. Payout rates may be changed and they can be viewed by logging into affiliate's account.

6.4. The commission structure does not apply to any of the following Babiva Products: Free hair samples and hair extension accessories. No commission payment will be provided for any orders including these products only. 

6.5. It is affiliates responsibility to determine if the payout for the link provided has been discontinued.

6.6. The commission is paid only on links that can be tracked and reported by Babiva affiliate program systems. In order for systems to track the referral, the customer must have cookies enabled.

6.7. Refunded payments do not qualify for commission fee.

6.8. Payments may be revoked in the instance that a code is leaked on third party websites. It is the affiliate's responsibility to ensure their code is not leaked. 

7. Babiva Obligations

‘We’ Babiva, agree to undertake the following obligations:

7.1. Providing the affiliate with promotional material, such as links, coupon codes, banners and any other graphic materials.

7.2. Processing all orders for Babiva products placed by following the affiliate's link.

7.3. Tracking the amount of sales generated through the affiliate’s’ link and all social media content via tags and mentions

7.4. Payment processing, cancellations, returns and other related customer service for Babiva for the purpose of business.

8. Affiliate Obligations

8.1. Affiliates are required to post on their social media platforms on a monthly basis two pieces of unique, original content 

8.2. Two pieces of content can include the following items: IG feed posts, IGTV, Youtube Video (review, get ready with me glam/date night, hair tutorials), blog post (review, hair tutorial). Additional content may include IG stories (4+ frames)

8.3. Instagram content must tag @babivahair on the photo and in the caption, plus the hashtag #babivahair, in order for Babiva to track all content created. Youtube and blog content must link back to Babiva website

8.4. All content must be sent directly to the influencer manager at the end of the month for accounting purposes and re-sharing opportunities 

8.5. Affiliate must be following @babivahair

8.6. Failure to follow affiliate obligations may result in affiliate content being overlooked and potential removal from the program.

8.7. If affiliates are unable to complete content, they may contact Babiva affiliate support team for assistance and provide reasoning.

8.8. Affiliate removal will take place if affiliates fail to oblige with content requirements set forth in this agreement.

9. The License

9.1. Babiva grants to the Affiliate a non-exclusive, non-transferable, revocable right to access Babiva site though the link in accordance with the terms of this agreement and in connection with the promotional materials provided and authorised by Babiva.

9.2. ‘We’ Babiva can use content created on social media platforms, website, ads. Influencer will always be credited.

9.3. Affiliates cannot modify or change any materials provided by Babiva in any way.

9.4. Both parties agree not to use other's materials in any manner that is misleading, disparaging or in any way portrays the party in a negative light.

9.5. Any inappropriate use of the promotional material may be cause for immediate termination of the agreement.

10. Liability

Babiva will not be liable to the Affiliate for the defects in the service, interruptions in the accessibility to the service, loss of data on the information handling system or viruses, loss of profits, loss caused by any third party deleting, removing, deactivating or tampering with the Affiliate tracking service or other consequential loss of whether arising from neglect or breach of contract.

11. Termination

The term of the agreement starts upon Babiva affiliate program acceptance of affiliate's application and can be terminated by either party. Affiliation can be ended with or without cause at any time, by giving the other party notice of termination in the form of e-mail. Upon the termination of the agreement, the affiliate will remove all links to Babiva website, as well as all banners and graphic images provided under the Program.

Program - The affiliate program as set out on the Site and is governed by this Agreement 
Affiliate - Party who agrees to take part in the Program 
Link - a HTML link provided to the Affiliate to link the Affiliate's website to the Site

LEGAL PURCHASE AGE

If you are under 18, we require that you inform a parent or guardian about BABIVA Privacy Policy and Terms and Conditions as well as requiring their consent to the Privacy Policy and Terms and Conditions before placing any order with us. Our Website is not intended for use by children under the age of 14, and we will not knowingly collect any information from any person below the age of 14.

SAFETY SECURITY

To protect your personal information, BABIVA takes reasonable precautions and follows industry’s best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. 

If we (BABIVA) make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. Changes and clarifications will take effect immediately upon their posting on the website.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

BABIVA may use your personal information for the processing of orders, payments and to provide you with a personalised shopping experience. We will also use your details to fulfill and deliver your orders. When you order from BABIVA, you will be offered the opportunity to opt out of our email newsletter and other update services. If you choose to opt-out for this service, we will not send you alerts for new products, features nor enhancements; special offers; upgrade opportunities; contests or events of interest. However, if you choose to receive our emails from time-to-time we will use the information you provide to promote the products and services via email. We do collect information about site traffic, sales, wish list, and other commercial information but do not share this information with any third parties. • If we are under a duty to disclose or share your personal data in order to: comply with any legal or regulatory obligation; respond to inquiries or requests from public authority; enforce or apply the BABIVA's Terms of Use and other agreements; permit us to pursue available remedies or limit the damages that we may sustain; or protect the rights, property, safety or security of Babiva Hair, our employees, agents, contractors, customers, the visitors of the Site or others.
